Welcome to learning.excelinsafety.net. These Terms and Conditions (“Terms”) govern your use of the platform as a course creator. By creating and offering courses on learning.excelinsafety.net, you agree to comply with and be bound by these Terms. Please read them carefully.
1. Course Content and Quality
1.1 Originality and Copyright Compliance
✔ You must create and provide original content that does not infringe on any third-party copyrights, trademarks, or intellectual property rights.
✔ Properly attribute any third-party content used within your course, ensuring compliance with all applicable copyright laws.
1.2 Quality Standards
✔ Produce high-quality content that is clear, accurate, and well-organized.
✔ Update your course content as necessary to ensure it remains relevant and accurate over time.
2. Licensing and Permissions
2.1 Grant of License
✔ You grant the Platform a non-exclusive, worldwide, royalty-free license to host, distribute, market, and sell your course content.
✔ This license remains in effect as long as the course is available on the Platform.
2.2 Permissions
✔ Affirm that you have obtained all necessary permissions and licenses for any third-party materials included in your course.
3. Pricing and Revenue Sharing
3.1 Revenue Share
✔ Course creators will receive 70% of the net revenue generated from the sale of their courses.
✔ The Platform retains 30% of the net revenue from each course sale to cover operational costs.
3.2 PayPal Fee
✔ PayPal charges a fee of 2.9% of the transaction amount plus $0.30 per transaction. This fee is deducted before revenue is split between the course creator and the Platform.
3.3 Example Calculation
✔ For a course priced at $100:
– PayPal Fee: $3.20
– Net Revenue (after PayPal fee): $96.80
– Platform Service Fee (30%): $29.04
– Course Creator’s Earnings (70%): $67.76
4. Course Offerings
4.1 Rule 1:2 (One Paid Course, Two Free Courses)
✔For every paid course you offer, you must also offer two free courses.
✔ Reason: Providing free courses allows learners to experience your teaching style and content quality, building trust and encouraging them to purchase your paid courses. It also increases accessibility to safety and health education for a broader audience.
5. Payment Schedule
5.1 Payment Frequency
✔ Payments to course creators are made on a monthly basis, within 30 days of the end of each month.
5.2 Payment Method
✔ Payments are processed through PayPal. You are responsible for ensuring your PayPal account information is accurate and up-to-date.
6. Marketing and Promotion
6.1 Marketing Efforts
✔ The Platform will undertake reasonable efforts to market and promote your courses through various channels.
✔ You are encouraged to participate in marketing efforts and provide promotional materials as needed.
6.2 Use of Name and Likeness
✔ You grant the Platform the right to use your name, likeness, and biography for marketing and promotional purposes related to your course.
7. Intellectual Property
7.1 Ownership
✔ You retain all intellectual property rights to your original course content.
✔ The Platform does not claim ownership of your content but holds the rights granted under the licensing terms described in Section 2.1.
8. Confidentiality and Data Protection
8.1 Confidential Information
✔ Both parties agree to keep confidential any proprietary information disclosed during the course of this Agreement.
✔ Confidential information shall not include information that is publicly available or independently developed by the receiving party.
8.2 Data Protection
✔ The Platform will handle all personal data in compliance with applicable data protection laws and the Platform’s privacy policy.
9. Termination
9.1 Termination by Course Creator
✔ You may terminate this Agreement at any time by providing 30 days’ written notice to the Platform.
✔ Upon termination, the Platform will cease to distribute your courses, but previously sold courses will remain accessible to enrolled learners.
9.2 Termination by Platform
✔ The Platform reserves the right to terminate this Agreement and remove your courses if there is a breach of this Agreement, including but not limited to violations of copyright laws, poor-quality content, or misconduct.
10. Dispute Resolution
10.1 Governing Law
✔ This Agreement shall be governed by and construed in accordance with the laws of [Governing Jurisdiction].
10.2 Arbitration
✔ Any disputes arising out of or related to this Agreement shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization].
11. Miscellaneous
11.1 Entire Agreement
